1. Who we are
Pass is a professional network and work-record product for hospitality workers and the venues that hire them, operated by Oventro Technologies Ltd. These terms are a binding agreement between you and Pass, wherever you use it.
2. Pass is not an employer or agency
Pass does not employ you, does not supply labour, and is not a staffing agency. In the UK, Pass does not act as an employment agency or employment business under the Employment Agencies Act 1973 or the Conduct of Employment Agencies and Employment Businesses Regulations 2003. Every shift, trial or job is a direct arrangement between you and the venue.
All pay is handled by the venue directly. Pass never charges a work-seeker fee, never takes a cut of your wage, and never processes your pay.
3. Your account
You must be at least 18 to hold an account. Keep your credentials secure and give accurate information. Roles you list may be confirmed by the venue named on them; misrepresenting a role is grounds for removal.
Your handle is a licence to use a unique identifier on Pass; it does not transfer ownership of any trade mark or name to you. Handles that impersonate a person or business, that you are not entitled to use, or that match a brand, venue or well-known name you are not authorised to represent, may be withheld, reclaimed, reassigned or removed by Pass at our discretion — including after a handle's public page is live. We may also reclaim or change a handle that is dormant or abusive.
4. Your content
You keep ownership of the clips, photos and text you post. You grant Pass a worldwide, non-exclusive licence to host, reproduce and display that content to operate and promote the service. You are responsible for having the rights and permissions to post anything you upload, including consent from anyone visible in it.
5. Acceptable use
No harassment or discrimination, no impersonation, no scraping, no unsafe kitchen practice presented as instruction, and no use of Pass to arrange unpaid work or off-book cash arrangements that break wage-and-hour, working-time, minimum-wage or right-to-work rules (in the UK, that includes National Minimum Wage law; UK discrimination law is the Equality Act 2010).
6. Liability and your statutory rights
Pass is provided "as is". To the maximum extent permitted by law we disclaim implied warranties, and our aggregate liability is limited to the greater of the amounts you paid us in the prior 12 months or US$100 / £100. Nothing in these terms limits liability that cannot be limited by law, and if you use Pass as a consumer in the UK, nothing here affects your statutory rights under the Consumer Rights Act 2015. We are liable for foreseeable loss caused by our breach; we are not liable for business losses.
7. Disputes and governing law
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules, and the state and federal courts located in California have jurisdiction.
If you live outside the United States: nothing in this section takes away the protection of the mandatory consumer law of the country where you live, and where those laws allow it you may bring proceedings in your local courts. UK consumers keep their statutory rights under the Consumer Rights Act 2015 (see section 6).
Arbitration: disputes are resolved by binding individual arbitration and class actions are waived. You may opt out of arbitration within 30 days of first accepting these terms by writing to hi@getonpass.com.
8. Complaints and changes
Write to hi@getonpass.com — we respond within 14 days. We may update these terms; material changes are notified in-app, and continued use after the effective date is acceptance.
